Huelga de hambre, hambre de justicia
(El profesor Santiago Mora Camargo)
SOLIDARIDAD CON EL PROFESOR MORA
El profesor Santiago Mora Camargo,
conocido mío por razones profesionales, es un distinguido antropólogo
colombiano cuya formación académica (grado de Maestría de la Universidad de la
Florida y Doctorado de la Universidad de Calgari, entre otras distinciones) y amplia
experiencia docente e investigativa, le han valido el honor de ser profesor
titular de St. Thomas University, en Canadá.
Pero, ¿qué llevó a un intelectual de
las calidades del profesor Mora a plantarse frente a la Corte de Fredericton,
New Brunswick, Canadá, en huelga de hambre, para exigir ser escuchado?
La respuesta no puede ser muy
diferente a la perplejidad del pobre Josef K (y acá me perdonarán la alusión
manida a Kafka) frente a un aparato judicial omnipotente,
soberbio e inaccesible que se niega a ponderar sus razones y pruebas de
inocencia.
Después de escuchar el relato inverosímil
pero cierto de Santiago, como en una suerte de confesión laica, comprendí mejor la obsesión de grandes literatos como
Dostoyevsky, Víctor Hugo, Kafka y Camus por el funcionamiento absurdo de la
justicia. Y todo esto en Canadá, un país que se precia de su respeto por el debido proceso. No me ocuparé de los detalles, mas el asunto tiene que ver, entre
otros aspectos, con que el profesor Mora ha sido demandado en Canadá por una
obligación patrimonial, ya cumplida en nuestra patria (es decir, pagadas todas las obligaciones dinerarias y patrimoniales inherentes), relacionada con los
bienes de una sociedad conyugal que fue disuelta y liquidada en Colombia
conforme a la ley, y que obra en una Escritura Pública debidamente otorgada en
una Notaría.
Al ser requerido por la Corte en cuestión, el profesor Mora ha solicitado que se tenga como prueba de la inexistencia de dicha obligación, la Escritura pertinente debidamente apostillada en los términos de la Resolución 4300 de 2012 del Ministerio de Relaciones Exteriores de Colombia, que establece el procedimiento para la legalización de documentos que deban surtir efectos en el exterior.
Al ser requerido por la Corte en cuestión, el profesor Mora ha solicitado que se tenga como prueba de la inexistencia de dicha obligación, la Escritura pertinente debidamente apostillada en los términos de la Resolución 4300 de 2012 del Ministerio de Relaciones Exteriores de Colombia, que establece el procedimiento para la legalización de documentos que deban surtir efectos en el exterior.
No obstante lo anterior, y quizá por el hecho peregrino de provenir de un pais suramericano, el juez en un acto de soberbia digna de mejor causa, desconoció de plano el valor probatorio del documento
en cuestión, negándole asimismo el exequátur,
esto es, la posibilidad de homologar ante la justicia canadiense su validez.
Lo cierto es que
Santiago permanece firme con su huelga de hambre frente a la Corte de
Fredericton, sin recursos para contratar un abogado, con la esperanza de que la justicia canadiense se digne considerar
las pruebas que demuestran el cumplimiento de sus obligaciones, amén de su
inveterado comportamiento de hombre íntegro, como lo pueden testificar a
requerimiento de las autoridades sus hijos, familiares, colegas, jefes, estudiantes,
amigos y conocidos. De no ser así, el profesor Mora Camargo será privado injustamente
de la mayor parte (el 83%) de su única fuente de sustento: su salario.
Por consiguiente, me
adhiero a la petición de justicia del profesor Santiago Mora Camargo, y espero
que los ilustres visitantes de este blog, la comunidad universitaria, así como
las autoridades consulares de Colombia en Canadá hagan eco de su clamor ante la Corte de Fredericton, New Brunswick, Canadá.

Professor Santiago Mora Camargo, a friend of mine for professional reasons, is
a distinguished Colombian anthropologist whose academic background (masters
from University of Florida and PHD from Calgary University, among others) and
broad teaching and researching experience have made him become a valuable
asset at the St. Thomas Aquinas University, in Canada.
But, what led a man of academy and intellect like Professor Mora, to set a stake
out in front of Fredericton’s Court in New Brunswick, Canada, and undergo a
hunger strike in order to demand to be listened?
The answer cannot be that different to the perplexity of poor Josef K (may you
forgive me the reference to Kafka) before an almighty judicial system, full of pride
and inaccessible, which refuses to assess his reasons or give any credibility to the
burden of proof of his innocence.
After listening to the unbelievable but yet real story of Santiago, like in some sort
of laic confession, I got to understand better the obsession of several great writers
as Dostoyevsky, Víctor Hugo, Kafka and Camus for the absurd mechanism of the
so called justice. Surprisingly enough this is taking place in Canada, a country
renowned for its respect for the right process.
I will not go into further detail, the problem has to do with the fact that Professor
Mora has been sued in Canada for a matter related to his patrimony, which had
already been solved in Colombia (it means all his debts had been paid, all the
liabilities related as well). This Patrimonial issue has to do with a divorce which
was dissolved in Colombia according to the legal standards, and with both parties
showing conformity with the agreement reached by them, there is even a public
deed about the matter.
At the moment of being requested by the Canadian court, Professor Mora asked
the court to validate as proof the inexistence of such liabilities and he cited the
public deed issued in Colombia, certified in the legal terms of decree 4300 2012
by the Colombian Foreign Affairs Ministry, which sets the procedures for legalizing
documents intended to have worldwide validity.
Nevertheless, and maybe due to the casual fact that the prosecuted comes
from a South American country, the judge, in an act of incomprehensible
arrogance, disregarded the validity of the document, and also denied Santiago the
“exequatur”, that is, the possibility of validating the document before the Canadian
judicial authorities.
The fact is that Santiago continues his hunger strike with unbreakable will before
the Fredericton court, without any resources to hire a lawyer, just trying to cuddle
the hope in his heart, that the Canadian justice finally decides to acknowledge the
proof that certifies the inexistence of any liabilities and the prompt accomplishment
of any obligations related to the matter.
Among other reasons, his behavior should be taken into account. He is an
upstanding, trustworthy man, as can be testified by his children, coworkers,
superiors at the University, students, friends and relations. If the court doesn’t give
Professor Mora a chance, he will be unfairly deprived from most of his one and
only income(83%), his salary.
Therefore I support the justice request that is being made by Professor Santiago
Mora Camargo, and I honestly hope that the visitors to this blog, the whole
university community and also the Colombian consular authorities in Canada
intercede before the Fredericton Court, in New Brunswick, Canada.

Darío, mi estimado peatón : El caso del profesor Mora Camargo, sólo viene a confirmar que estamos viviendo una época de injusticias, aumentadas por el sistema corrupto que priva en toda sociedad que presuma de demócrata. La "democracia" no es sino una palabra que usan los políticos, para barnizar sus discursos.
ResponderEliminarEntiendo la impotencia de muchos y muchas qué, creyendo en la justicia, se encuentran con la impunidad.
Que tan frustrado se puede sentir un ser humano, para (como lo hizo un hombre en Moscú) clavarse los testículos (¡auch! ) a los adoquines de una plaza, para protestar por la indiferencia de su gobierno.
Sabemos que hay manifestaciones de protesta alrededor del mundo por este estado de injusticia e indiferencia.
Solo nos queda apoyarnos entre los que queremos haya justicia. ¿En dónde debemos firmar para apoyar al profesor Santiago Mora Camargo?
